Thank you for using the 21 Days Challenge App. These Terms of Use (“Terms”) govern your use of the app, so please read them carefully.

Acceptance of Terms

By downloading, installing, or using the 21 Days Challenge App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the app.

User Accounts

To use certain features of the app, you may need to create an account. You are responsible for maintaining the confidentiality of your account login credentials, and you agree not to share your login information with any third party. You are responsible for all activities that occur under your account.

User Content

You may create and submit content through the app, such as goals, reminders, and progress updates (“User Content”). You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, perpetual, royalty-free license to use, display, reproduce, and distribute your User Content in connection with the app.

Prohibited Conduct

You agree not to:

  • Use the app for any illegal or unauthorized purpose;
  • Share your account login information with any third party;
  • Use the app to harass, abuse, or harm others;
  • Use the app to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • Use the app to upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable;
  • Use the app to upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
  • Use the app to upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
  • Use the app to violate any applicable laws or regulations.

Intellectual Property

All content and materials in the app, including without limitation the app software, graphics, text, images, logos, button icons, and audio clips, are the property of 21 Days Challenge App or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use any of these materials without our prior written consent.

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID TO US IN THE PAST TWELVE MONTHS.

Indemnification

You agree to indemnify and hold harmless 21 Days Challenge App and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs.
